TV star Bam Margera charged with DUI

Pennsylvania fans of “Jackass” may be interested to learn that Bam Margera was taken into custody and charged with DUI on Jan. 7. Authorities with the California Highway Patrol said that officers were conducting another traffic stop when the TV star drove by slowly while on his cellphone.

When authorities told him to pull over, they reported that they detected a strong odor of alcohol coming from the vehicle. He was given a field sobriety test and a Breathalyzer. Ultimately he was taken into custody where he was temporarily held on a $15,000 bail. However, he was eventually released on his own recognizance. While this is Margera’s first DUI charge, he has reportedly been suffering from alcohol abuse for many years.

When a person is charged with DUI, he or she faces both legal and administrative consequences. For example, a person facing drunk driving charges may be facing a jail sentence, probation and fines when it comes to the criminal case. On the administrative side, the person could face losing driving privileges. If the person needs a license to be able to get to and from work, this can be a factor in his or her ability to remain employed.

In some cases, a criminal law attorney could examine the drunk driving charges and search for inconsistencies or weaknesses in the case. For example, a challenge could be based on the authorities conducting the initial traffic stop without the requisite reasonable suspicion. In other cases, an attorney could assert that the breath test machine was improperly calibrated.
